Terms of Service
Welcome to Uncorkd. By creating an account or using the Uncorkd app or website (collectively, the "Service"), you agree to these Terms of Service. Please read them before signing up.
Uncorkd is operated by Uncorkd ("we", "us", or "our"). If you do not agree to these terms, do not use the Service.
1. Eligibility
You must be of legal drinking age in your country or jurisdiction to use Uncorkd. By creating an account you confirm that you meet this requirement. We reserve the right to terminate accounts where we have reason to believe this is not the case.
2. Your Account
You are responsible for keeping your login credentials secure and for all activity that occurs under your account. If you believe your account has been compromised, contact us immediately at hello@uncorkd.co.
You may not create accounts on behalf of others, impersonate another person, or use a username that is misleading or offensive.
3. Acceptable Use
You agree not to use the Service to:
- Post content that is false, defamatory, harassing, or otherwise unlawful.
- Attempt to gain unauthorised access to other users' accounts or to our systems.
- Scrape, crawl, or otherwise extract data from the Service in bulk without our written permission.
- Reverse-engineer, decompile, or disassemble any part of the app.
- Use the Service for any commercial purpose without our prior written consent.
We reserve the right to suspend or terminate accounts that violate these rules, at our discretion and without prior notice.
4. Your Content
You retain ownership of the content you submit — wine ratings, tasting notes, photos, and any other data you enter into the Service ("Your Content").
By submitting content, you grant us a non-exclusive, royalty-free licence to store, display, and distribute Your Content solely for the purpose of operating the Service (for example, showing your wine logs to friends you have connected with). We will never use Your Content for advertising without your explicit consent.
You are responsible for ensuring that Your Content does not infringe third-party rights (such as copyright in label images) and complies with applicable law.
5. Social Features
When you follow another user or they follow you, your shared wine logs become visible to your followers. You can control the visibility of your activity from your account settings. By using the social features you accept that content you choose to share may be seen by others within the app.
6. Intellectual Property
All elements of the Service — including the Uncorkd name, logo, design, and software — are owned by or licensed to us and are protected by intellectual property law. You may not copy, modify, or distribute them without our written permission.
7. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
8. Limitation of Liability
To the fullest extent permitted by law, Uncorkd will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of, or inability to use, the Service — including loss of data or goodwill.
9. Changes to the Service
We may modify, suspend, or discontinue any part of the Service at any time. We will give reasonable notice of significant changes where possible, but are not obligated to do so.
10. Changes to These Terms
We may update these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms. We will notify you of material changes via email or an in-app notice.
11. Governing Law
These Terms are governed by the laws of South Africa, without regard to conflict-of-law principles. Any disputes shall be resolved in the courts of South Africa, unless applicable consumer-protection law in your country requires otherwise.
